Terms of Service

1. Who we are

Lumiosa is operated by MANIGEN LLC, a limited liability company registered in Florida, United States ("Lumiosa," "we," "us"). These Terms of Service ("Terms") govern your use of the Lumiosa application at lumiosa.app, the Lumiosa Chrome extension, and related services (together, the "Service").

2. Acceptance of these Terms

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service. You must be at least 18 years old and able to form a binding contract to use the Service.

3. What the Service does

Lumiosa is a social media inbox and messaging tool. It lets you connect social media and email accounts you control (including Facebook Pages and Instagram professional accounts), view and manage incoming messages and comments in one place, generate AI-assisted reply drafts trained on content you provide, and send replies and direct messages through official platform APIs. AI-generated content is drafted for your review; you are responsible for what you send.

4. Your account and responsibilities

You are responsible for your account credentials and for all activity under your account. You agree to provide accurate information, to connect only accounts you own or are authorized to manage, and to comply with the terms and policies of any third-party platform you connect through Lumiosa, including Meta's Terms of Service and Platform Policies. If a connected platform suspends or restricts your account, that is between you and the platform.

5. Acceptable use

You agree not to use the Service to send spam or unsolicited bulk messages, harass or deceive others, violate any law, infringe intellectual property, distribute malware, or interfere with the Service. We may set and enforce rate limits designed to keep your connected accounts in good standing. We may suspend or terminate accounts that violate this section.

6. Your content

You retain ownership of the content you provide to the Service, including knowledge base material, message templates, and messages. You grant us a limited license to store and process that content solely to operate and improve the Service for you. We do not sell your content.

7. Subscriptions and payment

The Service is currently in early access. When paid subscriptions launch, pricing and billing terms will be presented at purchase and will form part of these Terms. We may change pricing with reasonable notice; changes will not apply retroactively to a paid period already in progress.

8. Intellectual property

The Service, including its software, design, and branding, is the property of MANIGEN LLC and is protected by applicable intellectual property laws. These Terms do not grant you any rights in the Service other than the limited right to use it.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted or error-free, that AI-generated drafts will be accurate or suitable, or that connected platforms will remain available or compatible.

10. Limitation of liability

To the maximum extent permitted by law, MANIGEN LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim arose, or one hundred U.S. dollars if you have paid us nothing.

11. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access for violation of these Terms, for risk to the Service or other users, or upon discontinuation of the Service. Sections that by their nature should survive termination will survive.

12. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the date above and take reasonable steps to notify you. Continued use of the Service after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any dispute will be brought in the state or federal courts located in Florida.
